Consumer Class Action Litigation |
|
Katz, Marshall & Banks, LLP is dedicated to representing consumers who are victimized by the unfair, deceptive and predatory business practices. Because the claims of individual consumers may be so small that the injured consumer has no practical recourse against a large corporation, the class-action lawsuit has proven to be a highly effective means of obtaining compensation for large numbers of consumers.
Partner David Marshall and Counsel Gary Peller have served as class counsel in several high-profile consumer class-action lawsuits. They played leading roles in a consolidated class action against the magazine sweepstakes industry in 1999-2000, resulting in a $40 million-dollar settlement. In 2001, Mr. Marshall and Professor Peller initiated nationwide class-action lawsuits against the largest "payday" lender in the U.S. Partnering with the AARP Foundation Litigation and other leading consumer lawyers, Mr. Marshall and Professor Peller were subsequently appointed co-lead counsel, and obtained a court-approved settlement that established an $11 million settlement fund and relieved low-income borrowers of over $50 million dollars in debt in 2004. The settlement also provided large cy pres awards to the National Consumer Law Center, the Community Reinvestment Association of North Carolina, and Texas Rural Legal Aid, Inc. — three organizations that are playing leading roles in the fight against predatory lending.
Big corporations and their friends in Congress have tried to limit the ability of consumers to use class actions to win compensation for unfair business practices, but the consumer class-action device remains an extremely important and effective tool for consumers today. Katz, Marshall & Banks, LLP welcomes inquiries from persons who believe they have been victimized by unlawful business practices that affect a large number of consumers in the same way, and will respond to those inquiries promptly and conscientiously.
