Appellate Practice
The Katz, Marshall & Banks Appellate Practice Group, led by Daniel Edelman, aims to become a leading appellate resource for plaintiffs and their counsel, assisting them in defending their jury verdicts, creating good law, and overturning unjust court rulings in civil rights cases and a wider range of other cases. The group’s attorneys have successfully argued cases before federal courts of appeals throughout the nation and numerous state appellate courts. Mr. Edelman, a former U.S. Supreme Court clerk, Lisa Banks, a former state Colorado Supreme Court Clerk and Appellate Specialist with the Equal Employment Opportunity Commission, and Professor Gary Peller, a constitutional law scholar, expert in torts and former federal district court clerk, have earned many appellate victories. These attorneys provide creative and forceful appellate advocacy, and have particular expertise in appeals that address complex issues in civil rights, employment law, torts, or constitutional questions. Whether the need is for a recognized civil rights or constitutional authority to argue a case, or for an attorney with broad-based appellate practice to work with a trial team to preserve issues for appeal, our practice group is the right choice for your appellate work.
Mr. Edelman recently prepared briefs, filed in the U.S. Court of Appeals for the Ninth Circuit and the California Court of Appeal, Fifth Appellate District, defending class certification orders in California wage-and-hour actions and opposing employer requests for pretrial, interlocutory review.
