Katz, Marshall & Banks partner Avi Kumin was quoted in the Law360 article “Exxon Workers’ Testimony Upheld in Race Bias Suit,” which outlines developments in Romdhani, Maloney, & Zeller v. Exxon-Mobil. KMB clients Sofiene Romdhani, Michelle Maloney, and BobbiJoe Zeller launched a civil rights lawsuit against Exxon-Mobil in November 2007 alleging discrimination, harassment, and retaliation based on their religion, race, and national origin, and seeking $12 million in damages. The November 12 article reports that Judge Leonard P. Stark of the U.S. District Court for the District of Delaware mostly denied Exxon’s motion to strike certain portions of the plaintiffs’ affidavits, rejecting Exxon’s arguments that paragraphs containing hearsay, newly presented facts, or conclusory statements should be stricken. Kumin is quoted saying “We’re pleased that the judge saw our side of things on three of the four issues raised by the defendant, and we are looking forward to presenting our position to the judge and moving forward toward trial.”
