The Big Chill: The Computer Fraud and Abuse Act and Whistleblower Disclosures

Published in National Law Journal

Katz, Marshall & Banks partner David Marshall, along with law clerk Andrew Schroeder, published an article in the National Law Journal yesterday discussing the conflict between the Computer Fraud and Abuse Act and whistleblower protections.  The article, entitled “The Big Chill: The Computer Fraud and Abuse Act and Whistleblower Disclosures,” focuses on a recent decision by the Ninth Circuit Court of Appeals to reconsider an earlier ruling upholding the criminal conviction of an employee who took documents from his employer’s computer system.
