Filoromo and LaGarde Publish Article on DTSA Whistleblower Protections

Katz, Marshall & Banks partner Michael A. Filoromo, III and law clerk Matthew LaGarde published an article in Law360 on June 2, 2016, entitled “Will DTSA Whistleblower Protection Be A Game-Changer?”  The article discussed the recently-passed Defend Trade Secrets Act of 2016 (DTSA), designed primarily to provide legal recourse under federal law to companies when their trade secrets are misappropriated.  The law was amended, however, to include protections for whistleblowers who appropriated trade secrets for use in reporting a suspected violation of the law to the government, or in supporting a whistleblower’s allegations that making such a report led to retaliation at the hands of his or her employer.  The article discusses potential issues with the DTSA’s whistleblower protections that may render those protections ineffective.
