Defendant Stone & Webster Construction Co., Inc. unlawfully discharged Mr. Speegle on May 24, 2004, from his job as a painter foreman in retaliation for raising serious questions and concerns with his immediate supervisor, other managers of "S&W", and onsite inspectors of the Nuclear Regulatory Commission regarding practices that he reasonably believed would jeopardize the effectiveness of the plant's emergency core cooling system, with potentially catastrophic consequences in the event of an emergency shutdown.

    David Marshall, an attorney representing Speegle, called it a "very important whistleblower case," in his opening statement. Marshall said the treatment of Speegle had a "chilling effect" on other workers and said it is important for nearby communities that workers feel able to speak up about nuclear plant safety issues.
    Speegle, who had worked at Browns Ferry for 12 years, testified his termination came after his repeated complaints to his supervisor at Stone & Webster and a few days after a meeting about those concerns with NRC officials.

    James Speegle, a former construction foreman at the Tennessee Valley Authority's Browns Ferry Nuclear Plant, filed a whistleblower lawsuit today against a TVA contractor in federal court in Huntsville, Alabama. Speegle's lawsuit alleges that Stone & Webster Construction, Inc. fired him in 2004 for reporting serious safety violations to the company's management and the Nuclear Regulatory Commission.
