On Thursday, October 3, 2013, Katz, Marshall & Banks partner Avi Kumin participated in an interview with Bloomberg BNA, an online source of legal, regulatory, and business information for professionals. The conversation covered a variety of pressing employment law topics, including:
- the implications of the U.S. Supreme Court’s recent decisions in University of Texas Southwest Medical Center v. Nassar and Vance v. Ball State University;
- the pros and cons of judicial review of the Equal Employment Opportunity Commission (“EEOC”) conciliation process;
- the progression of workplace anti-bullying laws, which have now been proposed in at least 25 states;
- restoring the tax-free status of noneconomic damages in employment cases;
- updating the damages cap in cases brought under 42 U.S.C. § 1981a, which has not been updated to keep track with inflation since its passage in 1991;
- increasing the damages cap available to plaintiffs suing employers with fewer than 100 employees; and
- the importance of the pre-litigation process in avoiding costly lawsuits and setting the stage for amicable dispute resolution.
