Naval Academy to Proceed with Court-Martial of Midshipmen Graham and Tate

The Naval Academy Superintendent, Vice Adm. Michael H. Miller, announced today that he was referring two Midshipmen for court-martial proceedings. According to the New York Times, Midshipman Eric Graham has been charged with abusive sexual contact and Midshipman Joshua Tate with aggravated sexual assault, and both are charged with making false official statements. Vice Adm. Miller’s decision comes following an Article 32 hearing in which Midshipman Doe was subjected to roughly 30 hours of abusive inquiries into legally-irrelevant topics such as whether she wore underwear the night of the party, and how much she needed to open her mouth to perform oral sex during consensual sexual encounters.

Susan L. Burke, who joined Katz, Marshall & Banks in early September and represents Midshipman Doe, told the New York Times that the victim was pleased that the matter was proceeding to court-martial. Burke said that “Despite the abusive Article 32 process, the victim is strong and remains willing to testify at trial.”
